Ammo.com's Terms of Use

All visitors to Ammo.com agree to the following Terms of Use by browsing the website or making a purchase from Ammo.com.

Statements of Customer

By placing an order from Ammo.com, you agree that the following statements are true:

  • I have not renounced my U.S. citizenship.
  • I am not a fugitive from justice.
  • I shall not commit any unauthorized export of defense articles.
  • I am not an illegal or unlawful alien, and I am not a nonimmigrant alien.
  • I am not currently less than twenty-one (21) years old.
  • I am currently not subject to a domestic violence restraining order of any kind.
  • I have not been adjudicated as a mental defective and I have not been committed to any mental institution.
  • I am not an unlawful user or addicted to any controlled substance.
  • By selling or delivering ammunition and/or firearm accessories to me, Ammo.com is not violating any state or local law or ordinance.
  • I have never been and I am not expected to be convicted in any court of a misdemeanor crime of domestic violence.
  • I am not under indictment for and have never been convicted in any court of a crime punishable by imprisonment for over one year.
  • I have never been and I am not expected to be discharged from the Armed Forces under dishonorable conditions.

Freedom Emails

We want to let you know about the latest updates to our ammunition offerings. You will start receiving these emails whenever you first register an account, provide us with your email address on our site, or place an order with our website. By doing so, you agree to allow Ammo.com to send you our weekly newsletter, and follow-up emails regarding your order. If you do not want to receive these communications, the power to stop receiving them is in your hands; simply click on the "unsubscribe" link at the bottom of any emails you receive from us. Customer Service Calls

We want to give you quality customer service. To do that, we need to be able to train and monitor our customer service representatives. Therefore, by placing an order with Ammo.com, you give us your authorization and consent to record and monitor your telephone calls with our customer service representatives.

Cancellation Policy

Please place your order carefully, because Ammo.com does not allow order cancellations; once you place an order, it is usually filled and shipped within a few minutess. We do our best to help our customers, but sometimes we fill and ship your order so quickly that it is out the door before we can locate it.

If you refuse to accept delivery of an order that you placed, then we must charge you the full cost of shipping plus a restocking fee equal to 10% of the value of my order. In this instance, the "full cost of shipping" is the cost to ship from our warehouse to your house, plus the cost to ship back to our warehouse (cost to ship back is the same cost as initial shipping). You will receive back the remainder of your original payment (minus shipping and restocking amounts, as explained above) as a store credit. You will not receive a refund.

Delivery

By placing an order with our website, you agree that once your order has been delivered to the shipping address, title changes from Ammo.com to you and you are solely responsible for your products.

Returns and Exchanges

Ammo.com wants to please all of its customers all of the time, but sometimes things just happen and our customers receive product that is damaged or defective (usually due to the carrier). We recognize this and we are here to help. If you receive damaged or defective product, please contact our office as soon as you can. All contact must be made within 30 days of your order date. If our office is made aware of damaged or defective product within thirty (30) calendar days of the date the product was ordered, you will be afforded a full refund, a full store credit, or a free replacement of the defective or damaged product (note that the product must be defective or damaged as inspected by our warehouse team upon return, and note that our office reserves the right to either refund your money, provide a store credit, or replace the product at our discretion). We do our best to make sure that everyone is treated fairly, so just let us know if an issue arises.

Shipping

If we made the rules, we would supply freedom (in the form of ammunition) to all fifty states. Sadly, we do not make the rules, so we do not ship outside the lower forty-eight states. We hope to see a day when this will change. When you purchase an order from us, you acknowledge that if fulfilled, your order will not cause Ammo.com to violate any federal, state, or local law or ordinance. Also, you agree not to submit orders for ammunition where your shipping address is in California, Washington, D.C., Massachusetts, Chicago, New York City, or any other area where such a transaction or delivery is prohibited by law. If you live in Connecticut, Illinois, New Jersey, or Rhode Island, we can ship to you if you provide the required permits or certificates prior to making your purchase. We may undertake to validate or verify your permit or certificate at our discretion. If you live in New York, we can ship to you, but your order will have to be sent to a federal firearms licensee or state-registered ammunition seller so they can perform a background check before giving you your ammunition. If you fail the background check, the order will be sent back to us, and you will be charged the full cost of shipping (from us to the dealer and back) plus a restocking fee equal to 10% of the value of your order. If you pass the background check, the federal firearms licensee’s or state-registered ammunition seller’s record as to when your order was transferred to you will establish the date and time that title your products transferred to you.

Disclaimer

Ammo.com does not design or manufacture the products we sell. All of the products you see on Ammo.com are designed and manufactured by someone else. Therefore, Ammo.com disclaims and you agree that Ammo.com will not be liable for any and every warranty of merchantability or fitness for a particular purpose, and you agree that Ammo.com will not be liable for any claims or damages based on any other possible legal theory, whatsoever.

Class Action Waiver

All legal actions brought by you must be brought on an individual basis. You may not consolidate legal actions, or bring legal actions as a representative or member of a class. By ordering products from Ammo.com, you acknowledge, agree, and affirm that you are knowingly, voluntarily, and permanently waiving your right to bring federal, state, or local claims as part of, or on behalf of, any class or any other individuals.

Indemnification and Agreement to Defend

To be clear, you alone are responsible for how you or others use the products you purchase from Ammo.com. By placing an order with our website, you agree that you will be obligated to hold harmless, indemnify, release, and pay to defend Ammo.com and its owners, agents, officers, and employees against any civil liability or criminal prosecution resulting from your purchase from or involvement with Ammo.com, whether brought by you or a third party, whatsoever.

Product Descriptions and Manufacturer Warnings

Ammo.com expressly disclaims all liability arising from errors in the way it describes product information, including pricing. Prices as shown on the site are final. Also, please be advised: you should check all product information and safety warnings published by the product manufacturer before you purchase or use ammunition. Manufacturers know more about their particular products than anyone else, and they are therefore invaluable resources for critical product information.

Applicable Law

By using Ammo.com, you agree that Colorado law exclusively controls your use of the site, and anything flowing from your use of the site.

Jurisdiction/Venue

You agree that if you, or someone else affected by your use of any product purchased on Ammo.com, brings a legal claim of any kind against Ammo.com, or any of its owners, agents, officers, or employees, that such legal action must be filed within a court located in El Paso County, Colorado. You also agree that if any such legal action is filed anywhere else, it must be immediately removed to a court within El Paso County, Colorado, and you agree that you will pay for all actions necessary to removing the legal action to a court within El Paso County, Colorado, including paying for all of our expenses in doing so.

Illegal or Suspicious Activity

You can anonymously report illegal or suspicious firearms or ammunition activity to the ATF by calling 1-800-ATF-GUNS (1-800-283-4867) or emailing ATFTips@atf.gov.

Tax Notification

We may be obligated to collect sales tax on your order depending on your state's laws.
